Welcome to 100PercentMarket.com (“Platform,” “we,” “our,” or “us”). By creating an account, listing products, or making a purchase on 100PercentMarket, you (“User,” “Seller,” or “Buyer”) agree to be bound by the following Terms of Service (“Terms”). Please read carefully. If you do not agree, do not use this Platform.

1. Marketplace Role 100PercentMarket is an online marketplace that facilitates the sale of digital products between independent sellers and buyers.

2. We do not create, own, or control the content sold.

3. We are not a publisher, reseller, or licensor of any seller content.

4. All transactions, rights, and liabilities are strictly between sellers and buyers.

5. Seller Responsibilities By listing products, each Seller agrees:

6. Their content is original work that they fully own, with all rights to sell and distribute.

7. Their content does not infringe on any copyright, trademark, intellectual property, or third-party rights.

8. They grant each Buyer 100% personal usage and commercial resale rights, which are:

• Non-exclusive (others may purchase the same product).
• Non-transferable (buyers may not sell or give away the rights themselves).

4. All sales are final; no refunds or reversals will be granted.

5. They will indemnify and hold harmless 100PercentMarket from any claim, dispute, or liability arising from their listings or conduct.

6. Buyer Rights & Responsibilities

By purchasing products, each Buyer agrees:

1. They receive 100% personal usage and commercial resale rights as described above.

2. Rights are non-exclusive and non-transferable.

3. All sales are final; no refunds, returns, or cancellations are permitted.

4. They are solely responsible for how they use, resell, or distribute purchased content.

5. The Platform is not responsible for verifying originality, legality, or suitability of content.

6. Payments & Fees

7. Sellers keep 100% of their listed price.

8. Buyers pay a platform licensing fee in addition to the seller’s price.

9. All payments are processed through third-party providers (e.g., Stripe, Sharetribe).

10. The Platform is not liable for payment delays, errors, chargebacks, or processing issues.

11. Intellectual Property

12. Sellers affirm that all listed works are their own original creations.

13. Buyers acquire usage and resale rights only; they do not acquire copyright ownership.

14. The Platform claims no ownership over seller content but may display listings for promotional or operational purposes.

15. Liability & Indemnification

16. The Platform is not liable for:

• Accuracy, legality, or originality of seller content.
• Buyer misuse of content.
• Damages, disputes, or claims arising from transactions.

2. Sellers and Buyers agree to indemnify and hold harmless the Platform, its owners, employees, and affiliates from any claim, demand, liability, or expense (including legal fees) resulting from their use of the Platform or content.

3. Termination We may suspend or terminate any account for violation of these Terms or at our discretion, without refund.

5. The Platform is provided “as is” and “as available” without warranties of any kind.

6. We disclaim all liability for errors, downtime, or loss of data.

7. Users acknowledge that all risk is assumed by Sellers and Buyers.

8. Governing Law These Terms shall be governed by and construed under the laws of the state of Indiana in the United States of America without regard to conflict of law principles.

9. Updates We reserve the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of changes.
